Flat sharing (colocation) in Luxembourg
Since 1 August 2024, flat sharing has its own rules in Luxembourg: a single written lease signed by every co-tenant, a co-tenancy agreement between them, and each co-tenant jointly liable to the landlord.

What counts as flat sharing under the law?
Several tenants renting the same home together under a single lease, with the landlord's express agreement. They all sign this written lease with the landlord.
If each person has their own lease (coliving), or in a sublet, it is not a colocation: there is then no joint liability between the tenants.
What is the co-tenancy agreement (pacte de colocation)?
A written agreement between the co-tenants, to be signed no later than the day the lease is signed; the lease records that date. At a minimum it must cover:
- how rent and shared charges are split, if the lease does not say;
- an inventory of the furniture and who owns it;
- energy and insurance contracts;
- how a co-tenant arrives and leaves;
- the rental deposit;
- how disagreements are settled.
Are co-tenants jointly liable?
Yes. Co-tenants are jointly liable for the lease obligations towards the landlord: the landlord can claim the full amount due from any one of them. Between themselves, if the agreement says nothing, obligations are shared equally.
How do I leave a flat share before the others?
Send your notice to the landlord and the other co-tenants at the same time, by registered letter, with 3 months' notice. Before the notice ends you must find a replacement, or prove an active and sufficient search, for example an advert in 2 property media within 15 days of the start of the notice.
When is the departing co-tenant released?
At the earliest of these three dates:
- the signing of the amendment admitting the new co-tenant;
- the end of the notice, if an active search is proven;
- at the latest, 3 months after the end of the notice.
Their guarantor's commitment ends on the same date. An intermediate inventory must be drawn up when they leave, and the remaining co-tenants sign an amendment to the agreement.
What if all the co-tenants want to leave?
All of them must sign the termination, send it by registered letter and give 3 months' notice. If at least half of the co-tenants give notice within 3 months of each other, the landlord can also end the lease, by a letter sent within a month of the last notice, with 3 months' notice.
A dossier for each co-tenant
In a flat share, the landlord looks at everyone's dossier. With the Rental Passport each co-tenant shows their own solvency score and verified documents, without passing payslips around. It is free for tenants.
