Agency fees in Luxembourg: split 50/50
Since 1 August 2024, an estate agency's fees for a rental are split equally between the landlord and the tenant. A lease clause that says otherwise has no effect.

Who pays the agency fees for a rental?
The landlord and the tenant, half each. If an estate agency or another intermediary is involved, its fees and commissions are split 50/50, whoever called on the agency.
Since when does this rule apply?
It comes from the reform of the residential lease law (law of 23 July 2024), in force since 1 August 2024. It applies to leases concluded from that date.
Can the lease put all the fees on the tenant?
No. Any lease clause that sets a different split is void and has no effect: the 50/50 split applies anyway.
What if I am asked to pay more than half?
Ask for a breakdown of the fees and point to the 50/50 rule. Keep a written record of what you are charged. In a dispute over the lease, the justice of the peace (justice de paix) is competent; for a dispute over rent or charges, the rent commission (commission des loyers) can also be asked.
Are agency fees part of the rental deposit?
No. They are two different things. The rental deposit, capped at 2 months' rent, is returned at the end of the lease; agency fees pay for the intermediary's service.
