Notice and ending a lease in Luxembourg
In Luxembourg, a tenant who wants to leave must give 3 months' notice, unless the lease sets a longer period. The landlord can only end the lease for a serious, legitimate reason, with 3 or 6 months' notice.

How much notice does the tenant give?
3 months, unless the lease sets a longer period. The lease may provide for 6 months or more: read it again before you send your letter.
How do I end a fixed-term lease?
The termination must fall on the day the contract expires, respecting the notice set in the lease. Otherwise the lease renews tacitly. Send your termination by registered letter with acknowledgement of receipt, so you have proof of the date.
Can we end it earlier by mutual agreement?
Yes. Landlord and tenant can end the lease by mutual agreement and freely set the move-out date, the inventory date, the key handover and, if relevant, a replacement tenant. Put the agreement in writing and have everyone sign it.
When can the landlord end the lease?
Only for a serious, legitimate reason, in principle by registered letter with acknowledgement of receipt. The reasons provided for:
- the personal need of the landlord or a relative;
- a breach of the tenant's obligations;
- major works that make it impossible for the tenant to stay.
Notice is generally 3 months, and 6 months for personal need. A personal-need letter must give its reasons and reproduce the text of the law, or it is void.
The landlord is selling: do I have to leave?
A sale alone is not a reason to end the lease. If the new owner wants to live in the home (personally or a relative up to the 3rd degree), they must send a registered letter within 3 months of the purchase, with 6 months' notice.
Can I get more time to leave?
Yes, before the justice of the peace. After a termination for personal need, you can ask for the notice to be extended within 3 months of receiving the letter; in total the period cannot exceed 18 months. If a judge has set a departure date, you can ask for a stay (sursis) at the latest 3 days before the deadline: each stay lasts at most 3 months, 9 months in total, and you must prove you are genuinely looking for a home.
Can I transfer my lease to someone else?
Generally yes, unless the lease contains a clause forbidding it. The departing tenant introduces a new tenant to the landlord, a new lease is signed between them, and the former tenant is released.
What happens to the lease if the tenant dies?
The lease continues, for an indefinite term, for the co-tenant, spouse or partner who lived with the tenant, or a descendant, ascendant or cohabitant who had lived there for at least 6 months and was registered at that address. Otherwise the lease ends. If the landlord dies, the lease continues with the heirs.
